By purchasing, installing, and/or using Duo Brake’s dual brake systems, defined as the “Bar Brake”, “Cable Brake”, and/or “Product(s)”, You, the “Customer”, agree to the terms and conditions outlined in this General Liability Release. This release is designed to clearly define the limitations of Duo Brake LLC’s liability concerning the use of the dual brake system.
You acknowledge that Duo Brake LLC’s dual brake systems are designed as an auxiliary device to stop a vehicle for emergency purposes from the passenger’s position when teaching to drive. The dual brake system is not intended to replace or serve as a substitute for the vehicle’s primary braking system. We are not responsible if your Product(s) are used in a manner incompatible with that intended design.
You acknowledge that Duo Brake LLC shall not be held liable for any accidents, injuries, deaths, property damage, or any other incidents that may occur as a result of the failure or malfunction of the dual brake system beyond the coverage provided under our limited lifetime warranty. You acknowledge that the installation of the dual brake system involves modifications to the vehicle, which may impact its original design and functionality. These modifications may void or alter any existing manufacturer, dealer, and/or any third party warranties on the vehicle. Duo Brake LLC shall not be held responsible for any voided warranties, loss of coverage, or any other impacts on the vehicle’s existing warranties resulting from the installation of the dual brake system.
You acknowledge that the installation of the dual brake system may result in irreversible modifications to the vehicle’s structure, components, or systems. Once installed, these modifications may permanently alter the vehicle’s original condition, and removal of the dual brake system may not fully restore the vehicle to its pre-modified state. Duo Brake LLC shall not be held responsible for any diminished value, appearance, or functionality resulting from these modifications.
You agree to release, indemnify, and hold harmless Duo Brake LLC, its affiliates, officers, employees, agents, and authorized installers from any and all claims, actions, suits, demands, losses, liabilities, damages, or expenses (including attorneys' fees) arising out of or related to the use, failure, installation, modification, or removal of the dual brake system. This includes, but is not limited to, any claims of negligence, product liability, or breach of warranty by Duo Brake LLC.
You acknowledge and agree that the dual brake system is intended solely for legal and authorized driving instruction purposes. It is designed to be used in accordance with all local, state, and federal laws governing driving instruction, including those requiring proper licensing by a certified or licensed driving school.
Any use of the dual brake system for commercial purposes not in compliance with applicable driving instruction laws, such as providing unauthorized driving lessons without a licensed driving instructor or driving school, will void any and all warranties, and Duo Brake LLC will not be held liable for any resulting accidents, injuries, deaths, property damage, fines, or legal actions.
You assume all responsibility for ensuring that the dual brake system is used in full compliance with the law and agree to indemnify and hold harmless Duo Brake LLC from any claims, fines, or legal consequences arising from its illegal or unauthorized commercial use.
By using the dual brake system, You acknowledge and understand the risks involved in modifying the vehicle and using the Product(s) as an auxiliary braking device. You assume all risks associated with the installation, use, and potential failure of the dual brake system, including the risk of accidents, injury, or death.
This General Liability Release is binding upon the customer and the customer’s heirs, executors, administrators, legal representatives, successors, and assigns.
This release shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from or related to this release shall be resolved in the courts of New York.
